Common Auto Accidents
Common auto accidents occur between a vehicle and another vehicle, or pedestrian, due to drunk driving, ignoring surroundings, reckless driving, rear-end collision, excessive speeding, ignoring stop signs, etc.
When common auto accidents occur, under the Article 709 of Japanese Civil Code, and Article 3 of Automobile Liability Security Act, the victims of such accidents can demand compensation against the assailant for damages caused by such accidents, for example; medical bills, lost wages, pain and suffering, disabilities and loss or damages to, or destruction of, properties.
In Japan, majority of drivers have in place voluntary automobile insurance coverage, and such automobile insurance coverage is used to pay the victim(s) of accidents. The victims usually negotiate with the insurance companies regarding the issue of compensation.
